1. Agreement

By using TextPack, a product of Wortham Innovations LLC ("TextPack," "we," "us"), you agree to these Terms & Conditions. If you do not agree, do not use the platform.

2. Service Description

TextPack provides a pay-as-you-go SMS messaging platform that enables organizations to send messages to their opted-in members and subscribers. Message credits are purchased in packs and do not expire.

3. Acceptable Use

You agree to use TextPack only to send messages to individuals who have explicitly opted in to receive them. You must not use the platform to:

Send unsolicited or spam messages.
Violate any applicable law or regulation, including the TCPA and CAN-SPAM Act.
Transmit harmful, abusive, or illegal content.
Impersonate another organization or individual.

4. Opt-In & Opt-Out

You are responsible for obtaining proper consent from all subscribers before sending messages. All messages must include opt-out instructions. TextPack automatically processes STOP replies and removes subscribers from your list.

5. Message & Data Rates

Standard message and data rates may apply for subscribers receiving SMS messages. Message frequency varies by organization. For help, reply HELP. To opt out, reply STOP.

6. Payments & Credits

Message credits are sold in packs (Spark, Connect, Reach, Broadcast). All purchases are final. Credits do not expire. Payments are processed securely by Stripe.

7. Account Termination

We reserve the right to suspend or terminate accounts that violate these terms, applicable law, or carrier guidelines without prior notice.

8. Limitation of Liability

TextPack is provided "as is." We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount you paid in the 3 months prior to the claim.

9. Changes to Terms

We may update these terms at any time. Continued use of the platform after changes constitutes acceptance of the updated terms.
